General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) define the rights and obligations between Fusional , operator of the website [www.fusional.fr], and any person wishing to make a purchase ("Customer").

These terms and conditions apply to all orders placed on the website, as well as to the use of associated services. By validating an order, the Customer acknowledges having read and accepted these Terms and Conditions without reservation.

ARTICLE 1 - ACCEPTANCE AND ENFORCEABILITY

In accordance with Article L. 113-3 of the French Consumer Code, these General Terms and Conditions of Sale (GTC) are made available to the Customer before any order is placed. They are accessible at any time on the Fusional website , at the following address: www.fusional.fr , and apply to all transactions carried out via this site.

By confirming their order, the Customer acknowledges having read and fully accepts these Terms and Conditions without reservation. They therefore waive the right to rely on any conflicting document, including their own terms and conditions of purchase. Any modification or deviation from these Terms and Conditions will only be valid if it is the subject of a written agreement signed by both parties.

The Terms and Conditions in effect at the time of the order supersede any previous version. The Customer may request to receive the Terms and Conditions by email and save, print, or retain them by any means of their choice. It is the Customer's responsibility to ensure they have the latest version.

Fusional reserves the right to modify its Terms and Conditions at any time. Any updates will be published on the website and will apply immediately to new orders placed after they are published online.

 

ARTICLE 2 - PRELIMINARY ELEMENTS TO THE CONCLUSION OF THE CONTRACT

Before placing any order and concluding the contract, the Client acknowledges having received, in a clear, legible and understandable manner, all of the following essential information:

- The main characteristics of the Products offered for sale;

- The total price, including delivery charges and any other additional costs;

- Delivery times and methods for the Products;

- Information relating to the identity of the Seller, his full contact details (postal, telephone and electronic) as well as the nature of his activity;

- The conditions and procedures for exercising the right of withdrawal, as well as the applicable legal guarantees;

- The possibility of resorting to a consumer mediator in the event of a dispute.

The Client's acceptance of this information is a prerequisite for any order validation on the site.

 

ART 3 - PRODUCTS

Product offers on the Site are valid only while stocks last.

Product availability may fluctuate throughout the day depending on the company's sales. While we regularly update stock information on the Site, we cannot guarantee that the quantity displayed online will exactly match the actual stock. In the event of a stock shortage after order confirmation, the Seller will inform the Customer by email within seven (7) days of the order, specifying the delivery time required to receive the product. The Customer may, if they wish, cancel their order and receive a refund by bank transfer within fourteen (14) days, or opt for an exchange for another available product, by contacting our team at the following email address: contact@fusional.fr

Each product is detailed on the Site with a complete description, including information on its photograph, price, available sizes and colors, as well as its main features. It is important to note that product images may show slight variations from the actual product, particularly due to differences in color rendering between customers' screens.

The Fusional team ensures that all products comply with applicable legal standards and health and safety requirements.

 

ARTICLE 4 - ORDERING PROCESS

The customer can select items from our catalog and add them to their Shopping Cart . Once they have finished selecting items, they can proceed to checkout by clicking the "Checkout" button . Before finalizing the order, they will need to provide the necessary information, including their contact details and payment information.

At any time before confirmation, the customer can view and modify their order details. Order confirmation implies full and complete acceptance of our General Terms and Conditions of Sale (GTC) . If the customer does not agree to these conditions, they will not be able to complete their purchase on our website.

Order validation establishes a sales contract between the customer and the sole proprietorship FUSIONAL , subject to the availability of the items ordered.

A A confirmation email summarizing the order details will be sent to the customer after validation.

ARTICLE 5 - RIGHT OF WITHDRAWAL

In accordance with Article L.121-20 of the Consumer Code, the customer has a period of 14 days from the receipt of their order to exercise their right of withdrawal, without having to justify any reason or pay any penalties, with the exception of return costs.

For any return requests, please contact us at contact@fusional.com to obtain the necessary instructions.

Returned products must be in their original packaging, in perfect condition, and accompanied by the order number to be accepted.

 

ARTICLE 6 - PAYMENT TERMS

Customer Commitment

Upon acceptance of the order by the Seller, the Customer agrees to make full payment of the amount due.

If payment is not received, the order cannot be processed and will be automatically cancelled.

Payment Due Date

The FUSIONAL team will only ship products after receipt and clearance of funds. No deliveries can be made until full payment is received.

Billing

A A detailed invoice is issued by the Seller and given to the Customer upon delivery of the products. It can also be downloaded from the Customer's personal area, under the "My Profile" section.

⚠️ Payments in installments are not accepted.

 

ARTICLE 7 - SECURE TRANSACTIONS AND PERSONAL DATA

The bank details transmitted during payment are encrypted and protected, making them impossible to read during transmission. As soon as the customer confirms their payment, the transaction is immediately debited after verification of the information provided.

By providing their bank details during the purchase process, the customer expressly authorizes the seller to debit their card for the total amount indicated. They also confirm that they are the legal holder of the payment method used and are authorized to use it.

All transactions made on our site are secured by the universal SSL (Secure Socket Layer) encryption system, guaranteeing both the authenticity of the payment provider and the complete confidentiality of the data. At no time do we have access to the customer's login credentials or bank card numbers.

The personal data provided during the ordering process is strictly confidential and used exclusively by the company to ensure the proper processing of purchases and associated services.

ART 8 - PRICE

Product prices are displayed and invoiced in euros (€), inclusive of all taxes (TTC) for orders destined for the European Union.

For orders shipped outside the European Union, customs duties, local taxes or import fees may apply according to the regulations in force in the country of destination.

These additional charges, which vary depending on local customs authorities, are the sole responsibility of the customer and must be paid directly to the carrier or customs services at the time of delivery.

We recommend that the customer check with the relevant authorities in their country before finalizing their order to avoid any surprises regarding these additional charges.

 

ARTICLE 9 - FORCE MAJEURE

Neither party shall be held liable for any delay or inability to perform its contractual obligations if such delay or inability results from a case of force majeure, that is to say, an unforeseeable, irresistible event beyond their control.

The following are considered as cases of force majeure, without this list being exhaustive: fire, extreme weather conditions, natural disasters, pandemics, major accidents impacting the company, general strike, shortage of raw materials or energy resulting from a global cause.

In the event of force majeure, delivery will be postponed to a later date, once the event has resolved. Neither the customer nor the seller will be entitled to compensation for any damages incurred as a result of this delay.

If the force majeure situation persists for more than three (3) weeks, each party will have the option to terminate the contract by registered letter with acknowledgment of receipt, without charge.

In this case, FUSIONAL undertakes to reimburse the customer for the sums paid at the time of the order. However, no other compensation or damages may be claimed.

All elements present on this website, including its technology, content, design, and architecture, are protected by copyright, trademarks, and patents. The trademarks, logos, designs, and models visible on the site are the exclusive property of FUSIONAL .

Any reproduction, distribution, modification or use of these elements without prior authorization is strictly prohibited and constitutes a violation of intellectual property rights, which may lead to prosecution for counterfeiting.
